TERMS AND CONDITIONS OF SALE AND USE OF THE WEBSITE

These terms and conditions govern the purchase of antiques on the website www.lestanzedellamemoria.com in full compliance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree No. 206/2005, amended by Legislative Decree No. 21/2014 and Legislative Decree No. 70/2003 on electronic commerce. These terms and conditions are subject to change and the date of their publication on the website is equivalent to the date of their entry into force.
You may not use our products for any unlawful or unauthorised purpose, nor may you violate any applicable laws in your jurisdiction while using the Service (including, but not limited to, copyright laws).
You must not transmit any worms, viruses or any code of a destructive nature.
Violation of any of the Terms and Conditions will result in the immediate termination of the Services. This website may contain some historical information. Historical information is not necessarily current and is provided for reference purposes only. We reserve the right to change the contents of this website at any time, but we are under no obligation to update the information on our website. You acknowledge that it is your responsibility to periodically review any changes to our website.

SUBJECT OF THE CONTRACT

Under these general terms and conditions of sale, the customer purchases the antique products indicated and offered for sale on the website www.lestanzedellamemoria.com remotely and, therefore, the contract is concluded exclusively online, through the customer's access to the website www.lestanzedellamemoria.com.
Before proceeding with the purchase, the customer undertakes to read these general terms and conditions of sale and to accept them by ticking the box indicated.
Pursuant to Article 51, paragraph 1 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, the customer will also receive a link to download a copy of these general terms and conditions of sale in the order confirmation email.

CONCLUSION AND EFFECTIVENESS OF THE CONTRACT

The sales contract is considered concluded when lestanzedellamemoria@gmail.com sends the customer an order confirmation email. The e-mail contains the customer's details and order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent.

PRICES

The prices of our products are expressed in Euro, inclusive of taxes, excluding shipping costs and subject to change without notice. For countries outside the EU, the customer pays the price of the product + shipping costs + duties/taxes of their country.
We reserve the right to modify or discontinue the Service (or any part or content thereof) at any time without notice.
We accept no liability to you or any third party in relation to any changes, price changes, suspensions or discontinuations of the Service.

PURCHASES

Please note that the images of the products presented on www.lestanzedellamemoria.com should be considered representative of the condition and state of the item. Click on the product you are interested in for further information. You will find a description, high-quality images and information on the provenance and history of the piece. Please ensure you read all the available information carefully. If you require further information or images, please send an email to lestanzedellamemoria@gmail.com. If you have any questions or concerns, please do not hesitate to contact us. We have made every effort to display the colours and images of our products in our shop as accurately as possible. We cannot guarantee that the colours displayed on your computer will be accurate.
Before confirming the order, the customer receives the following information: total price of the goods including taxes, with details of shipping costs and any other costs; payment methods; the deadline by which the goods will be delivered; conditions, terms and procedures for exercising the right of withdrawal; notice that the customer will bear the cost of returning the goods in the event of withdrawal; existence of the legal guarantee of conformity for the goods purchased. Any complaints regarding damage, missing items, or delivery to the wrong address must be sent to LE STANZE DELLA MEMORIA by email within a maximum of 5 days from the delivery date shown on the courier's website, otherwise they cannot be accepted.
BESPOKE PURCHASES
When purchasing Bespoke items, please ensure you have carefully read the product information, measurements and finish of the item offered. If you require further information for a specific service, please do not hesitate to contact us and we will provide you with all the information you need to modify your order with your measurements and specifications.

PAYMENT METHODS

We accept various payment methods to offer our customers maximum flexibility and security. You can choose to pay by credit card Visa, MasterCard and Maestro, if you wish to shop online, or by instant bank transfer or debit card (Bancomat)if you are paying in-store. All transactions are protected by advanced encryption systems to ensure data security. Payment must be completed before the goods are dispatched, unless otherwise agreed. In the case of advance bank transfer, the order will only be processed once the payment has been confirmed.

SHIPPING

We currently ship our products to various destinations worldwide using the best couriers on the market. During the checkout process, we will ask you to enter your shipping address, and if your destination is supported, you will be able to complete your order. If you have any questions about shipping to a specific destination, please do not hesitate to contact us.
During checkout, you can select the ‘Pick up at store’ option: you will be notified by email with the pick-up times.

SHIPPING TIMES AND METHODS

LE STANZE DELLA MEMORIA undertakes to deliver the goods within 7 working days from the sending of the order confirmation email to the customer, and will communicate any different timing if there are problems of a different nature due to the type of item and the time of year. However, some items may take longer to prepare and package due to their unique nature. We will provide you with an accurate estimate of delivery times before completing your order.
If the parcel is not delivered for reasons attributable to the customer (incorrect address, recipient always absent, incorrect telephone number, etc.), or if the customer refuses delivery, the shipping costs will be deducted from the refund due to the customer. If you receive an item damaged during shipping, please contact us immediately. We will ask you to provide photographs of the damaged packaging and the item itself. We will resolve the issue as quickly as possible, offering you a full refund (excluding shipping costs).

RIGHT OF WITHDRAWAL

If the Customer is a ‘Consumer’, as defined in Article 3 of the Consumer Code, they have the right to withdraw from the purchase without penalty and without specifying the reason, within 14 days from the date of receipt of the products. Customers who wish to exercise their right of withdrawal must notify us by email at lestanzedellamemoria@gmail.com, specifying their intention to withdraw from the purchase and the goods for which they wish to exercise their right of withdrawal. In the event of exercising the right of withdrawal, the customer is required to return the goods at their own expense within 14 days from the day on which they communicated their intention to withdraw from the contract pursuant to Article 57 of Legislative Decree 206/2005. The goods must be returned to the headquarters in Milan 20121, Corso Venezia 29, intact, in their original packaging, complete in all their parts, including packaging and attached tax documentation proving the purchase. Without prejudice to the right to verify compliance with the above, the amount of the products subject to withdrawal will be refunded within a maximum period of 30 days, excluding shipping costs.

RETURNS AND REFUNDS

That said, if the goods are shipped within the European Union, you have the right to cancel or return your order within 14 days for any reason and without having to provide any justification.
As above, the item must be in the same condition in which you received it, it must not have been used, and it must be contained in its original packaging. You will also need the receipt or proof of purchase. As provided for in Article 56, paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, LE STANZE DELLA MEMORIA may suspend the refund until the goods are received at the LE STANZE DELLA MEMORIA headquarters in Milan 20121, Corso Venezia 29. The refund will be made using the same payment method chosen by the customer at the time of purchase. Once we have received the returned item and verified that it is in the same condition as when it was sent, we will proceed with the refund of the amount paid (excluding shipping costs) within 30 days of the return of the goods.
Items sent without a prior return request will not be accepted. Please inspect your order upon receipt and contact us immediately if there are any defects or damage, or if you have received the wrong item. This will allow us to assess the problem and resolve it.
We cannot be held responsible if the returned item arrives broken, damaged or lost, or in any case not in its original condition, and without having chosen an insured or traceable postal service, it will not be possible to proceed with a refund.

EXCEPTIONS/BESPOKE RETURNS

Only items purchased in the Bespoke section, in particular those made ‘TO MEASURE’ i.e. with your specifications regarding measurements, finishes, fabric, or customised items, cannot be returned. Therefore, please be as careful as possible when listing your requirements. Please do not hesitate to contact us for personalised advice.
For items purchased as shown in the online photos, the return policy is the same as that found in the RETURNS AND REFUNDS section.

LEGAL GUARANTEE OF CONFORMITY

In the event of receiving defective products or products that do not conform to the orders placed, the customer has the right to withdraw from the contract without incurring any costs for the conformity of the product through repair or replacement of the product. The customer may exercise this right provided that they report the defect to LE STANZE DELLA MEMORIA within two months of discovery and if the defect occurs within two years of delivery of the goods (Art. 132, Consumer Code). The customer must also present the proof of purchase. Beyond this period, LE STANZE DELLA MEMORIA will not be liable for any defects in conformity found by the customer. In any case, for the rules governing the legal warranty, please refer to the provisions of the Consumer Code in Articles 128 et seq.
Legal warranty for non-consumer customers (professionals): professional customers, as defined in Article 3 of the Consumer Code, are entitled to the legal warranty provided for in the Civil Code. This warranty requires that the Non-Consumer Customer, under penalty of forfeiture, report any defect found in the purchased product to LE STANZE DELLA MEMORIA within 8 (eight) days of discovery. The above legal warranty is valid for a maximum period of 12 months from delivery of the product. Beyond this period, LE STANZE DELLA MEMORIA shall therefore not be liable for any defects found by the Non-Consumer Customer.
We cannot guarantee that the colours displayed on your computer are accurate.

LIABILITY

LE STANZE DELLA MEMORIA declines all responsibility for disruptions attributable to unforeseeable circumstances or force majeure, including those caused by malfunctions and disruptions of the internet network, if it is unable to execute the order within the time specified in the contract. Please note that once the package has been delivered to the courier, the latter will be responsible for any delays or malfunctions in the service.

APPLICABLE LAW AND JURISDICTION

The contract concluded with LE STANZE DELLA MEMORIA and these General Terms and Conditions of Sale are subject to Italian law. Any dispute arising between the contracting parties shall be subject to the exclusive jurisdiction of the court of the place of residence or domicile of the customer, if located within the territory of the State.
